Letting out your flat - Important information to flat owners

If you currently let out your property, or are considering letting it, you need to comply with the following:

  • Flats must never be let as ‘Houses’ of Multiple Occupancy (HMOs)

  • Flats must not be let as accommodation for asylum seekers

  • Flats must not be let on temporary/emergency arrangements e.g. night by night lets

  • Flats must not be let as holiday type accommodation e.g. Airbnb or similar

 

Tenants must be referenced and fully identified as having the right to rent.

 

You should ensure tenants are aware of how and where to dispose of waste, and parking restrictions where applicable.

 

Your tenants must not

​

  • leave anything in the grounds for removal

  • leave anything in hallways

  • they must not to prop open fire doors, flat front doors or the main entrance door

  • they must not leave windows in the communal hallways open

 

If you let your flat to a third party such as a council/agent you are responsible for ensuring all these conditions are complied with.

You must comply with any local authority licensing requirements. If you are unsure of these, you need to find out what is required in your area.

​

Flat owners who let their flats remain fully responsible for all actions of the flat occupants so any breaches of the rules will be treated as if committed by the flat owner. Breach of leases will be issued to the flat owner with costs and persistent offenders or those causing danger to others will lead to the flat owner having to take steps immediately to remove tenants.

Any damage/loss caused to communal areas/other flats from anyone living in your flat or associated with the person living in your flat will be charged to the flat owner.

​

Each year owners are issued with information with the annual accounts. Within the Notes to Accounts document is information you must pass to your tenants/letting agent annually. These are titled:

  • Electrical Fires
